XPERT RENT - Terms and Conditions

1. Our Role and Services

1.1. Intermediary Service: XPERT RENT ("we", "us", "our") operates a car rental booking website. We act as an intermediary or agent, connecting you ("the Customer", "you") with third-party car rental providers ("Rental Supplier").

1.2. No Vehicle Ownership: We do not own or operate any vehicles and are not a car rental company.

1.3. Rental Contract: Your contract for the car rental itself will be directly between you and the Rental Supplier. You will be subject to their specific rental terms and conditions, which you must agree to when you collect the vehicle. We will make these terms available to you during the booking process.

2. The Booking Process

2.1. Making a Booking: To make a booking, you must complete the online booking form with all necessary details, including rental dates, location, and driver information. It is your responsibility to ensure all information provided is accurate.

2.2. Vehicle Class: We guarantee the vehicle category you book, but not a specific make or model. The images on our website are for illustrative purposes only. If the booked vehicle class is unavailable, the Rental Supplier will provide a vehicle from the same or a higher category at no extra cost.

2.3. Booking Confirmation & Voucher: Once your booking is accepted and payment is processed, we will send you a booking confirmation Voucher via email on behalf of the Rental Supplier. This Voucher is essential and must be presented at the rental desk. If you do not receive your Voucher within 24 hours, please contact our customer service.

2.4. Driver Age: You must meet the minimum and maximum age requirements of the Rental Supplier. These age limits will be displayed on our website during the booking process. Age-related fees may apply for younger or senior drivers.

3. Pricing and Payment

3.1. What's Included: The price quoted will clearly show what is included, which typically covers the vehicle rental, mandatory local taxes, and any included insurance (like Collision Damage Waiver - CDW).

3.2. Payment Models: Depending on the Rental Supplier and location, one of the following payment models will apply:

• Full Prepayment: You pay the full cost of the rental at the time of booking.
• Partial Prepayment (Booking Deposit): You pay a deposit to secure the booking, and the remaining balance is paid directly to the Rental Supplier upon vehicle collection.
• Pay on Arrival: No payment is taken at the time of booking. You pay the full rental cost directly to the Rental Supplier upon vehicle collection.

3.3. Security Deposit: A security deposit is mandatory and will be blocked or charged on the main driver's credit card at the time of pick-up. This deposit covers potential costs like insurance excess, fuel, or traffic fines. The amount is set by the Rental Supplier. XPERT RENT does not handle or have access to your security deposit. The deposit will be released by the Rental Supplier after the vehicle is returned, provided there are no new damages or outstanding charges.

3.4. Optional Extras: Additional items like GPS, child seats, ski racks, or adding an additional driver can be requested during booking. These are subject to availability and are paid for locally at the rental desk, unless specified as a prepaid item.

3.5. Currency and Fees: All payments made at the rental desk must be in the local currency. If you pay with a card in a different currency, your card issuer will apply their own exchange rate and may charge a foreign transaction fee.

4. Vehicle Pick-Up

4.1. Required Documents: To collect the vehicle, the person named as the main driver must present the following original documents. Photocopies or digital versions are generally not accepted.

• Booking Voucher: A printed or electronic copy.
• Valid Driver's License: From your country of residence, held for a minimum period (usually 1-2 years).
• International Driving Permit (IDP): May be required along with your national license, depending on the country and Rental Supplier.
• Valid Passport or National ID Card.
• Valid Credit Card: The credit card must be in the main driver's name and have sufficient funds to cover the security deposit. Debit cards, prepaid cards, and cash are often not accepted for the deposit.

4.2. Failure to Provide Documents: If you fail to present any of the required documents, or if your credit card does not meet the requirements, the Rental Supplier may refuse to release the vehicle. This will be treated as a "No-Show," and no refund will be provided.

4.3. Vehicle Inspection: Before driving away, inspect the vehicle for any pre-existing damage. Ensure all scratches, dents, or issues are documented in the rental agreement or on a vehicle condition report. Take photos for your records.

5. Cancellations, Modifications, and No-Shows

5.1. Cancellations:

• Free Cancellation: You may cancel your booking free of charge up to 48 hours before the scheduled pick-up time.
• Late Cancellation: If you cancel less than 48 hours before pick-up, a cancellation fee may apply, as stated in your booking confirmation.
• Post Pick-Up Time: No refunds will be issued for cancellations made after the scheduled pick-up time.

5.2. Modifications:

• You can request to modify your booking via the "My Booking" section on our website up to 48 hours before pick-up.
• We do not charge an administration fee for modifications, but changes to the location, vehicle group, or rental period will likely alter the total price.
• All modifications are subject to availability and confirmation.

5.3. No-Show: A "No-Show" is defined as any of the following:

• You fail to pick up the vehicle at the specified time and date without prior cancellation.
• You fail to provide the required documentation (as listed in Section 4.1).
• You fail to provide a valid credit card in the main driver's name with sufficient funds for the security deposit.
• You are deemed unfit to drive by the Rental Supplier (e.g., under the influence of alcohol or drugs).

In the event of a No-Show, no refund will be issued.

5.4. Early Return: If you return the vehicle earlier than the agreed drop-off date, we cannot provide a refund for the unused days.

6. Liability

6.1. Limitation of Liability: XPERT RENT acts solely as a booking agent. We are not a party to the rental contract between you and the Rental Supplier. Therefore, we are not liable for any acts, errors, omissions, or negligence of the Rental Supplier or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom.

6.2. Our Liability: In the event of a dispute directly related to our booking service, our liability to you, if any, is limited to the amount of the commission we earned from your booking.

6.3. Force Majeure: We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from any cause that is beyond our reasonable control. Such causes include, but are not limited to: acts of God, war, terrorism, natural disasters, pandemics, and government-imposed travel restrictions.

7. Complaints

7.1. Complaints about Our Service: If you have a complaint about our booking service, please contact our customer support team within 28 days of your rental's completion.

7.2. Complaints about the Rental Supplier: If your complaint relates to the Rental Supplier or the vehicle, you should address it directly with them at the time. If you are unable to resolve the issue, please inform us, and we will try to assist, but we cannot guarantee a resolution.

8. Data Protection

8.1. We are committed to protecting your personal data. We will process your information in accordance with our Privacy Policy to facilitate your booking. By making a booking, you consent to us sharing your booking details with the relevant Rental Supplier.

9. Intellectual Property

9.1. All content on this website, including text, graphics, logos, and software, is the property of XPERT RENT or its suppliers and is protected by copyright and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

10. Governing Law

10.1. These Terms are governed by the laws of Montenegro. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Montenegro.
